New In-Demand Occupations, New Application Procedure

Like what I have always been saying, Immigration Regulations are subject to changes and that the longer you delay your decision to apply, the more you are risking your eligibility. There is a new Ministerial Instruction affecting Federal Skilled Worker program applications. This is basically the change I was referring to in April 2010 Visa Bulletin.

Effective June 26, 2010, Citizenship and Immigration Canada will process applications under Federal Skilled Worker program only for applicants with:

  • a valid offer of arranged employment, OR

  • one year of continuous full-time or equivalent part-time paid work experience in at least one of the 29 in-demand occupations


  • Temporary foreign workers and international students will no longer be part of the Federal Skilled Worker program. They may now apply under Canadian Experience Class.

    The new Ministerial Instruction also covered changes in the application procedures. Simplified Application Process is now totally wiped out.

    In sending your application to Centralized Intake Office (CIO), you now need to submit results of an independent language test (IELTS or TEF: Test d’évaluation de français) even if your first language is English or French. You also need to submit copies of documents required specifically by the Canadian Visa Office responsible in processing your application.

    What's in it for you?

    1. Filed to CIO before June 26, 2010, Waiting for Assessment Notice

    If your application was received by Centralized Intake Office (CIO) before June 26, 2010 even if and your occupation is no longer included in the new in-demand list, the changes will not affect your application at all.

    The Ministerial Instruction stated that if your application was received before June 26, 2010, it will be processed according to the rules that were in effect at that time. However, some say it wasn't clear if the basis is the receipt by Centralized Intake Office or Canadian Visa Office.

    To clarify, here's what was stated in Canada Gazette.

    All Federal Skilled Worker applications received by the Centralized Intake Office in Sydney, Nova Scotia, on a date prior to the Canada Gazette publication date shall continue to be considered for processing having regard to the first set of Ministerial Instructions. [Source]

    It was published June 26, 2010. It is clear that if your application was received by CIO before that date and that your occupation is no longer included in the new in-demand occupations, your application would still be processed.

    2. Interested to immigrate to Canada, Occupation not included in the new in-demand list


    If you are interested to live and work in Canada but your occupation is not included in the new list of priority occupations, you still have the chance to immigrate to Canada if:
  • You have an arranged employment in Canada, or

  • You have somebody to sponsor you under Provincial Nominee Program

  • This could be of help: How to find jobs in Canada.

    While at that, you should start preparing yourself for the IELTS Examination. You should also start preparing your documents. The objective is to be able to file your application immediately when the list changed and included your occupation.

    If you will prepare your documents only when your occupation is included, then it may be too late for you. Remember that Citizenship and Immigration Canada will be imposing a cap on the number of applications it will process per occupation each year.

    Be ready!

    3. Filed before February 27, 2008, Occupation included in the new priority list

    If you have a pending PR Visa application, whether it's under FSW or PNP, and that your occupation is included in the new priority list, you may want to submit a new application to CIO in order to expedite the process. The Visa Office in Manila is yet to finish applications filed in 2004. It may take a while before applications filed in 2007 and 2006 will be processed.

    If you submit a new application, you will get the result within 6-12 months. The only disadvantage of doing this is that you may not be able to refund the processing fee you paid to the Visa Office before. You will need to pay another visa processing fee.

    4. Included in the list, Not yet filed to CIO

    If your occupation is included in the new list of in-demand occupations and that you are seriously considering the opportunity to live and work in Canada, YOU MUST FILE YOUR APPLICATION NOW!

    For the next twelve months, Citizenship and Immigration Canada will only consider a maximum of 20,000 complete applications under the occupation list. Within the 20,000 cap, a maximum of 1,000 federal skilled worker applications per occupation will be considered for processing each year.

  • These new Ministerial Instruction will affect you only if you applied on or after June 26, 2010. If your application was received before June 26, 2010, it will be processed according to the rules that were in effect at that time.

    If your occupation is not included in the 29 in-demand occupations, you will need an Arranged Employment to apply to Federal Skilled Workers program.

    Update: Ministerial Instruction 3 (MI-3) identified the same 29 in-demand occupations to be accepted from July 1, 2011 to June 30, 2012

    Passport Renewal Concern

    So you are now in the final stage of your application. You were given 45 days to submit your Machine Readable Passport. Problem is when you check with DFA, the earliest appointment they could give you is September 2010.

    Do not panic. Here's a good news for you.

    OFWs need not wait for passport appointment, according to Department of Foreign Affairs (DFA)



    “Returning OFWs and those that are due for overseas deployment can have their passports processed immediately provided that they present documents that show there are jobs waiting for them in their countries of destination,” said the statement of the DFA-OCA.

    “Similarly, employment agencies with passport applicants are given special slots for immediate processing and expedited issuance of passports,” it added.

    On top of this, the DFA satellite office at the Philippine Overseas Employment Agency (POEA) in Ortigas will also re-open on June 22 (not June 21 as earlier reported) to cater solely to the needs of OFWs.

    The DFA has also increased the number of passport appointments to accommodate more applicants.[Source]

    That's based on the online survey conducted by Ipsos Reid.

    OTTAWA—A majority of people from around the world would move to Canada if presented with the opportunity, according to a survey out Tuesday.

    The online survey of over 18,000 people in 24 countries, conducted by Ipsos Reid, showed that 53 percent of people -- including 77 percent of respondents from China and 68 percent from India -- would like to live in Canada, if they could.[Source]

    Any man can be a father. It takes someone special to be a dad

    Immigrating to Canada is not an easy decision to make, especially so if you have already established your career in your home country. Moving to Canada without an assurance that you'll gonna land the same job that you are used to do is discouraging.

    But why do people immigrate to Canada?

    It takes a lot of courage and determination to arrive at a decision to live and work in Canada. Without commitment to this decision, one will just fail.

    How to get Canadian Police Clearance

    For Canada Visa application purposes, Canadian Visa Office normally requires Police Certificate from countries where you stayed for six months and more. If you previously worked in Canada and is now in your home country, here's how to get Canadian Police Clearance from outside Canada.

    1. Contact the nearest police force which offers fingerprinting services. The RCMP will accept fingerprint forms from foreign countries that contain the following:


  • rolled and flat impressions of all ten fingers taken with black ink

  • full name, date of birth and sex of the applicant

  • the name and address of the police agency

  • the signature of the official taking the fingerprints

  • If the police service in your country does not have fingerprint forms for non-criminal purposes, you can obtain an RCMP C-216C form by contacting Civil Fingerprinting Screening Services (CFSS) e-mail at civilnps@rcmp-grc.gc.ca and provide the following information:

  • your name

  • mailing address, and

  • specify the number of forms required.


  • 2. Applicants for immigration to Canada must enter the name and address of the Canadian Immigration Center, Embassy, Consulate or High Commission handling the case in the "Name and Address of Contributing Agency/Dept" portion of the C216C. If you have an immigration file number, write it below the address as a reference for immigration officials.

    Ensure you provide:

  • your full name

  • date of birth

  • sex

  • mailing address

  • phone number

  • and/or fax number

  • and/or e-mail address

  • Do not provide any additional personal information with your request. This material provides no value to the service and will be destroyed.


  • 3. Send your request to:

  • 4. Processing fee is not required if the purpose is for Application for Immigration to Canada.

    Currently, the time to process criminal record verifications can be more than four months. In many cases it can be less; however, RCMP do not guarantee that you will have your reply in less than that amount of time.

    Federal, provincial and territorial governments agree to improve Canada’s immigration system

    Ottawa, June 15, 2010 — Federal, provincial and territorial ministers responsible for immigration met in Ottawa today to discuss ways to improve Canada’s immigration system, given its increasing importance to Canada’s future.

    “If Canada wants to succeed in the global economy, our country must be able to attract and retain immigrants with the skills it needs today while preparing us to face the challenges of the future,” said Jason Kenney, federal Minister for Citizenship, Immigration and Multiculturalism. “After today’s discussion, I am confident that our governments’ combined efforts will help position Canada as a destination of choice for the world’s best and brightest, while continuing to maintain our humanitarian tradition.”

    “Immigration is important to all provinces and territories,” said Ramona Jennex, Nova Scotia’s Minister of Immigration on behalf of her provincial and territorial colleagues. “We agreed here to improve our cooperative approach to immigration to ensure its benefits are shared across the country. We are pleased that future meetings will be co-chaired by the federal and provincial governments.”

    This meeting occurs at a time when the increasing importance of immigration to Canada’s competitiveness is undisputed. Within the next few years, Canada’s labour force growth will depend on immigration. Welcoming immigrants with the skills we need is essential to build Canada’s future labour force.

    Ministers agreed that the future of immigration would embrace welcoming and supporting newcomers to join in building inclusive, diverse and vibrant communities and a prosperous Canada. This recognizes the increased involvement of provinces and territories in jointly managing the immigration system, as well as Quebec’s responsibility under the Canada-Quebec Accord.

    Ministers discussed the importance of planning immigration levels on a long-term basis to make immigration more responsive to economic and regional needs. As Canada emerges from the recession, we must also continue to ensure skilled workers selected are those most likely to succeed.

    Minister Kenney reported on progress made in reducing the backlog for federal skilled worker applications under the Action Plan for Faster Immigration, but that applications are once again above the level that can be processed in a timely way. Ministers discussed the need to remain flexible in order to control the flow of applications, while working to allow provincial nominee programs to respond to emerging labour market needs.

    The ability of immigrants to succeed in Canada’s labour market is also critical to building an immigration system that is responsive to Canada’s economy. Given provincial and territorial responsibility for recognizing foreign credentials, ministers discussed work to date on the Pan-Canadian Framework for the Assessment and Recognition of Foreign Qualifications. As the Framework states, all governments are working towards the common goal of ensuring that foreign qualifications are recognized in a fair, consistent, transparent and timely manner.

    Ministers recognized the continued importance of supporting settlement and integration programs being delivered across the country to ensure the successful integration of newcomers into their communities. Ministers agreed to work together to improve measuring and reporting outcomes, and committed to developing a pan-Canadian framework that would establish a common set of successful settlement indicators across jurisdictions, as well as an assessment of service delivery models. Under the Canada-Quebec Accord, Quebec is responsible for its own settlement services including the evaluation of its programs. However, the province will share best practices as part of this exercise.

    As well, Ministers agreed that Canada must increase its vigilance and cooperation to prevent and reduce fraud in the immigration system.

    Ministers also committed to work together to ensure that Canada continues to improve its standing as a destination of choice for international students seeking a quality education.

    Underlying all of these discussions was recognition of the unique needs of provinces and territories, as well as Canada’s values of diversity, inclusiveness and equality of opportunity.

    A goal without a plan is just a wish

    Ms. Neslien Regencia is due to give birth for their first child this coming September. But unlike most, she will no longer need to worry about maternity related expenses. They have just landed in Vancouver few days ago and three months from now, they will be entitled to FREE health care!

    Aside from the health care, the child will be entitled to Child Tax Banefits - a monthly allowance until 18 years old!

    Mr and Mrs Regencia are both nurses. We filed started processing their application last. After a positive assessment from Centralized Intake Office (CIO), we send their application forms with supporting documents to Canadian Embassy Manila on November 2009. They received their visa just last month. Around 6 months processing.

    This is what I love about my job. Knowing that you were able to help make a diffirence for other people's lives is priceless.

    Kindly note down the following details:-

    Has the Manitoba Provincial Nominee Program ended?

    There are rumors circuating around that the Manitoba Provincial Nominee Program (MPNP) will be ending this year. I often receive this kind of question about MPNP.

    Has the Manitoba Provincial Nominee Program ended?

    If you have questions about Canada's immigration programs, always consult the official website first. That's what I did and here's the answer I found:

    No. The MPNP does not end. There is no deadline date to submit applications.


    Ok. The site's FAQ may not be updated. Now, consider what I've found from Labour Market Bulletin - Manitoba (May 2010):

    The province has announced that it will increase the minimum wage by 50 cents an hour to $9.50 on October 1. The Manitoba Labour Federation was advocating for an increase of 75 cents an hour effective April 1, while business leaders were advocating for either an increase of no more than 30 cents or no increase at all. Manitoba created almost 7,000 jobs in April, increasing from 612,200 employed to 619,000 over the month.

    The unemployment rate for Manitoba in April was 4.9%, up from the 4.6% unemployment rate for April 2009, while the labour force participation rate increased from 68.9% to 69.8% in the same time period.

    In 2009, over 12,000 immigrants entered Manitoba, the largest annual immigration total since 1913. This increase from the 3,725 immigrants to Manitoba in 1999 means that immigration levels have tripled in the last decade. This increase has been attributed to the provincial nominee program which was introduced in 1998. The province has a target of increasing immigration to 20,000 immigrants per year 2017.

    I've been trying to search for official announcements regarding the planned ending of MPNP but without luck. What I do know is that they are still processing applications. In fact, here's a MPNP applicant I have assisted who were issued visa just recently.

    Mr and Mrs Vergara, together with their children will be moving to Canada before the school year begins this year. They were sponsored by Mr. Vergara's former colleague and kumpare.

    To qualify under MPNP General Stream, you need two distant relatives or friends who are ready and willing to support you. In their case, the wife of Mr. Vergara's kumpare served as the 2nd sponsor.

    Mr. and Mrs Vergara are both doing great on their chosen fields. But they still decided to immigrate to Canada because of one thing - they want to prepare a better future for their children. It is a major decision and takes a lot of courage to get out of your comfort zone. But they did it just the same and it's for a noble intention. Hats off to the Vergara couples!

    Cracking Down on Crooked Consultants Act

    Citizenship, Immigration and Multiculturalism Minister Jason Kenney introduced today in the House of Commons a legislation to crack down on crooked immigration consultants who exploit prospective immigrants. It's called Cracking Down on Crooked Consultants Act.

    The Cracking Down on Crooked Consultants Act would strengthen the rules governing those who charge a fee for immigration advice, close immigration system loopholes currently exploited by crooked consultants, and improve the way in which immigration consultants are regulated.

    “While most immigration consultants working in Canada are legitimate and ethical, it is clear that immigration fraud remains a widespread threat to the integrity of Canada’s immigration system,” said Minister Kenney. “The Cracking Down on Crooked Consultants Act will better protect prospective immigrants from crooked consultants and help safeguard our immigration system against fraud and abuse.” [Source]

    If passed, the law will give the Minister the authority to designate a body to govern immigration consultants and establish measures to enhance the government’s oversight of this body. Canadian Society of Immigration Consultants is the body currently governing immigration consultants. Since the Minister himself recognizes the lack of public confidence in the regulation of immigration consultants, it is expected that a change in the governing body may be implemented.

    In the Philippines, there are only few immigration consulting firms prior to the Ministerial Instructions introduced on November 2008. That is because immigration process takes about 5 years and thus, applying for immigration to Canada is not that popular. But after the changes, wherein the processing was only about 6-12 months, several immigration consulting firms suddenly sprouted like mushrooms. Most of which are crooked consultants described in the Cracking Down on Crooked Consultants Act.

    Beware of these crooked immigration consulting firms. Deal only with legitimate consulting firms like Canadian Immigration Consultancy. We have been in the industry for 2 decades now and have already sent thousands of Filipino workers to Canada.

    Refused due to medical inadmissibility

    Here's another case of visa refusal due to medical inadmissibility.

    A French family family was denied permanent resident status because their seven-year-old daughter suffers from a mild form of cerebral palsy. It was considered a condition that may require excessive demand on medical services.

    A French couple, Sophie and David Barlagne, recently experienced bitter rejection by a still selective immigration policy.

    They arrived in Canada five years ago on temporary work permits, full of hope, and started a small software firm in Montreal.

    How to maka a Personal Study Plan


    So you want to study in Canada and already got your letter of acceptance from a school in Canada. Now you are about to submit your Study Permit application to the Canadian Visa Office. Problem is you don't know how to make a Personal Study Plan, which is part of the requirements.

    This is for you.

    If you are from Manila, the only information you will find from the kit about the study plan is this:


    A personal study plan: a description of your proposed program of studies as it relates to your academic, technical, or vocational background.


    That information may not be enough and probably the reason why you search the net and landed on this blog searching for more information. Or maybe not. :-)

    But just the same, this could be of help. Your study plan should address the following issues:
  • a. Why you wish to come to Canada to study at the school and in the program for which you have been accepted;

  • b. What is your overall educational goal;

  • c. Why you are not pursuing less expensive alternatives in your home country (What are those alternatives? Have you investigated them?);

  • d. What ties do you have to your home country that will lead you to return home following your course of studies?

  • e. How will this Canadian diploma/degree increase your chances in the labor market in your home country?

  • It should be in a letter format addressed to the visa officer. You may also mention details of your accommodation arrangements and how will you support your studies - sources of funds, etc.

    Canadian Embassy Manila Processing Time Delay


    Recently, a number of our clients has been wondering why they do not receive notice from the Canadian Visa Office-Manila even after the 45 days processing time indicated on their acknowledgment letter. This of course makes most of them worried about their application.

    Are you in similar situation?

    You shouldn't worry if there's a delay, it has nothing to do with your documents. Give it 2 weeks alloance before you make a follow up. There seems to be delay in processing due to volume of applications the visa office is reviewing.

    The new acknowledgemt letter we received recently indicates a different processing time.


    Processing Time:


    Applications for permanent residence in Canada in the category in which you have applied are finalized in an average of 6 to 12 months in our office. If you have not received any instructions from this office within 90 days from the date of this letter, please contact us directly and inform us of this.


    That used to be 45 days.

    The same thing is true with those who have submitted their original passports, waiting for their visa. It used to be returned with 2-3 weeks. But now, it takes longer.

    “We will make our best efforts to have your passport(s) returned to you with your visa(s) within 90 days from their receipt at the Embassy. You should not make any plans to travel to Canada until you are in possession of your passports and the required visas.”


    Processing period remains to be 6-12 months from the time the Visa Office received your application with supporting documents, after assessment from Centralized Intake Office.

    So there. That explains why there is a delay. Avoid unncessary stress. It's not you, it's the embassy. ;-)
