If you are applying for a work permit to legally work in Canada, there is no need to get Certified Employment Clearance from Canadian Employment Services Representative Office.

So if you received a job offer but the employer advised you to contact Canadian Employment Services Representative Office, consider it a red flag. It's a SCAM!

Here's an example from an employer who introduced himself as General Manager of The Resort Hotel Canada:


Good Morning,

This is Reference to your documents submission. To further your employment and work permit visa that will enable you live and work in Canada.

You are advise you to contact Canadian Employment Services Representative Office in Europe(For Non Canadian Citizen Office) as per working permit visa requirement for Non Canadian citizen.

You have been referred to contact Canadian Employment Services Representative Office for non Canadian residence on the address Below,

To legally work in Canada as a Temporary Foreign Worker, a Labor Market Opinion (LMO) is normally required. It's the employer who needs to get it for you from Human Resource and Skills Development Council (HRSDC).

Once you have the LMO and Employment Contract, you will then have to submit an application for a Temporary Resident Visa to Canadian Visa Office responsible for your country of citizenship or residence. There's no need to get clearance from Canadian Employment Services Representative Office, which does not exist.

Possible Changes: 2011 FSW New Requirements and Procedures | MI-3

We now know that the 29 in-demand occupations would still be the priority list under the Ministerial Instruction 3 (MI-3).

What we don't know yet are the possible changes affecting the Federal Skilled Worker program.

Quite possibly, the proposed changes to FSW points system would be implemented starting July 1, 2012. The proposed changes are meant to make it easier for skilled tradespeople, technicians and apprentices to meet the passmark and to attract immigrants who will adapt more easily and be active members of the work force for a longer time frame.

If implemented, the ideal age would be 21-35 years old and that there would be a minimum level of language proficiency depending on the applicant’s occupational skill level (i.e. a nurse would have a different requirement from a welder).

The current points system is prohibitive and I think the proposed changes on the language factor proficiency actually makes sense. Not many welders talk to their welding rod using English language, so how do you expect them to score 16 points under the Language factor?

2-3 months window of opportunity

For some of the occupations listed in the 29 in-demand occupations, there is a great chance that the cap would be reached within 2-3 months only, or even faster for some.

For those who did not plan ahead or simply failed to plan, they may have a hard time making it on time. For Filipino applicants, for example, it now takes forever to renew or get a new passport.

If your occupation is included in the 29 in-demand occupations and you are seriously planning to live and work in Canada, waste no time. Decide now!

MI-3: The Same List of 29 Occupations | Limited to 10,000 applications, Maximum of 500 per occupation

We now have an idea what the 3rd Ministerial Instruction (MI-3) would be like. The list of 29 in-demand occupations would be retained. However, details on new application requirements and procedures would be made available only on July 1, 2011.

So far, here's what's certain:

1. Citizenship and Immigration Canada will limit the intake of new applications to 10,000 between July 1, 2011 and June 30, 2012.

2. Only maximum of 500 applications per occupation would be considered.

There are other changes affecting the Federal Investor Immigrant Program and Federal Entrepreneur Program but I will cover that on another blog post.

This is just a quick post to let you know of this breaking news.

Quebec-Selected Skilled Workers Program


Few days from now, the new list of priority occupations will be released by Citizenship and Immigration Canada through the 3rd Ministerial Instruction (MI-3). At this point, we don't know yet what occupations will be included and how many applications per occupation would be set as cap. In other words, your occupation may or may not be included.

Quebec-Selected Skilled Workers Program

As an alternative, you may want to try Quebec-Selected Skilled Workers Program. That is if you interested to live and work in Quebec.

The good thing about Quebec-Selected Skilled Workers Program is that there is no restricted occupations and a job offer is not required. You will have an advantage though if you know French Language and have immediate relatives living in Quebec.

Canada is considered by many Filipinos as the land of milk and honey. Because of Canada's health care system, great income opportunities and other social benefits, more and more Filipinos are immigrating to Canada.

Canada and the Philippines have a good relationship. The Philippines is one of the major sources of immigrants needed by Canada to address its labor shortage problem. On the other hand, the Philippines is one of the major importers of Canadian asbestos. Yup, asbestos. Great deal, eh?

Exposure to asbestos can cause lung inflammation and cancer according to studies. Thus, there's a call for Canadian government to ban mining and exporting asbestos but it isn't listening.

OTTAWA - Canada's opposition on Tuesday blasted the government for ignoring its own scientists' advice to stop the mining and exporting of asbestos to countries like the Philippines, one week before a major UN conference on dangerous products.

Many applicants now write the Canadian Visa Office in Manila regarding the illogical and unfair explanation on the delay in processing - the Ministerial Instruction 2 applicants were being prioritized.

The good thing is that the Visa Office is actually replying to applicants' letters. Here's a one of the replies from the visa office to the letter sent by Physician applicant who filed under MI-1 and is yet to received the result. The applicant's friend who filed under MI-2 have done the medical examination already.

Please note that the purpose behind the changes between the various Ministerial Instructions is to allow the Canadian Government to target our efforts at bringing in skilled workers to specific occupations which meet Canada's labor demands. Although MI-1 is no longer in force and has been replaced by MI-2, NOC 3112, General Practitioners and Family Physicians remains on the list. There is no different priority accorded to NOC 3112 in either list as all occupations in both lists are treated with equal priority.

Regardless of which MI you had applied under as NOC 3112, your application would receive the same priority.

By giving priority to FSW applications received on or after June 26, 2010, CIC is responding to the most urgent labour market needs first.

That was pretty clear - applications received on or after June 26, 2010 are being given priority. And when this illogical and unfair decision was exposed, here's what they say now:

Regardless of which MI you had applied under as NOC 3112, your application would receive the same priority.

It should have been OK. Only that it isn't what's happening. I advised the applicant to make a rejoinder. I will keep you posted.

If you're one of those affected by the delay in processing for applicants filed under Ministerial Instruction 1 (MI-1), you have two options.

First, you may just wait until your application is reviewed (12 months from the time the visa office received your application) or second, write a letter to the visa office to voice out your protest. I suggest you do the second.

How to Keep Your Car If Entering Canada from the U.S.

Many immigrants from Asia applying for Canadian visas came to the United States first. If they had established livelihoods in the U.S. for years before being told they could no longer re-apply for a visa or gain citizenship, it presents a particular problem about where to go to next. Either they can go back to their home country or try another industrialized nation to move to. Immigrants in America who are told they cannot stay oftentimes look to relocating to the U.S.'s northern neighbor as an option to preserve their western way of life.

Canadian immigration bureaucracy aside, the transition can be difficult. Even assuming you clear the qualification hurdles and successfully cut through the red tape, the cultural shift from the U.S. to Canada is not like moving from New York to Pennsylvania. You undoubtedly already had the difficult task of understanding and adapting to the American way of life, and despite the similarities in language, geography, and culture, the two countries are very different. Prepare for higher taxes and a harder time finding a place to settle that has accessibility to employment and the necessities for a family you may or may not have in tow.

But there are perks. The higher tax means better social welfare programs especially for those getting started on a visa. It also means superior public transit, something you might not be familiar with if you originally lived in the US. Chances are you got yourself an automobile while living in America, so you might opt to put it in a metropolitan storage center, like a Toronto self storage facility, if you can't find a place to live right away that has room for a vehicle. If you move to a Canadian city then mass transit will easily take you wherever you need to go, and anywhere else can be accessed by getting the car out or taking the train.

They say America is the land of opportunity but if the U.S. government rejects your visa then perhaps your only hope of further opportunity lies in Canada. But remember the process is not easy, and even success through the rigmarole of becoming a temporary and hopefully permanent subject of the Commonwealth of Canada doesn't mean you won't have further logistical issues to worry about. But if there's a will there's a way, and if you had the will once to journey across the ocean to get to the U.S., then relocating once more across the northern border will be a cinch.
