In this webinar, we will explore various pathways to becoming a permanent resident in Canada. Participation in the webinar is free!
What is Humanitarian and Compassionate Consideration?
The Humanitarian and Compassionate (H&C) consideration pathway is an important option for individuals who are not eligible for permanent residence through regular immigration programs but have compelling personal circumstances that warrant consideration. It allows individuals who are already in Canada, including those without legal status, to apply for permanent residence based on humanitarian grounds. This pathway takes into account factors such as the applicant's ties to Canada, their potential for integration, and the hardship they would face if they were forced to leave.
Eligibility Requirements
The Humanitarian and Compassionate (H&C) consideration pathway is intended for applicants who:
-
Are currently in Canada (either with legal status or without).
-
Have unique circumstances that make them deserving of permanent residence even though they do not meet the criteria for any other immigration programs (e.g., Express Entry, Family Class, or Provincial Nominee Program).
While there is no formal list of specific situations that qualify for H&C consideration, typical cases often involve situations where individuals would face undue hardship if they were required to leave Canada.
How to Apply for H&C?
Information about applying for H&C is available on Canada's immigration website (http://ircc.canada.ca). Hiring an Immigration Lawyer or a Regulated Canadian Immigration Consultant is not mandatory for this application.
